The law on the profession of lawyer is already the fundamental act that guides the administration of the National Chamber of Advocacy towards best, contemporary practices and an organizational transformation, where services to lawyers and applications for lawyers take priority, and an efficient appeal system. This radical change does not happen overnight, but the foundations have been laid and clearly and irrevocably are working towards a modern model system. The new partnership with active lawyers enables more interaction, requires recognition and honest implementation of rights and obligations on both current legislation and help for its implementation, from the administration of DH.KA\n\n<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fb70c4f elementor-widget elementor-widget-text-editor\" data-id=\"fb70c4f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><span lang=\"SQ\">The administration of DH.K.A has the duty to inform its members about the content, role and importance of the legislation in the field.<\/span><\/li><li><span lang=\"SQ\">The Department of Service and Registration of Assistants for Lawyers at DH.K.A in Albania has the role of informing and helping all applicants through informative materials, using all means of mass and individual communication.<\/span><\/li><li><span lang=\"SQ\">Official communication with the members of the chambers is sent to the address declared by him and the personal phone number noted in the lawyer&#039;s register.<\/span><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e89dd72 elementor-widget elementor-widget-spacer\" data-id=\"e89dd72\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db548c8 class=\"elementor-heading-title elementor-size-default\">The lawyer may practice his profession throughout the territory of the Republic of Albania and before any court, prosecution or public administration body.\n<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c8323af elementor-widget elementor-widget-text-editor\" data-id=\"c8323af\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><b><span lang=\"SQ\">\u00a0<\/span><\/b><span lang=\"SQ\">The lawyer exercises his profession individually or in cooperation with other lawyers, being organized in law offices.<\/span><\/li><li><p><span lang=\"SQ\">The lawyer can practice his profession even outside the territory of the Republic of Albania, in accordance with the law of the state where legal aid is provided.<\/span><\/p><\/li><li><p><span lang=\"SQ\">A lawyer, during the exercise of his profession, cannot be, at the same time, a judge, prosecutor, notary, civil servant or employee of the administration.<\/span><\/p><\/li><li><p><span lang=\"SQ\">In any case, the lawyer in the practice of the profession is identified with the number of the permit to practice the profession, as well as his fiscal code or that of the law office where he is a member.<\/span><\/p><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-abcc4cd elementor-widget elementor-widget-spacer\" data-id=\"abcc4cd\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5d77886 elementor-widget elementor-widget-heading\" data-id=\"5d77886\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">The lawyer, in the exercise of his profession, has the right to request from public administration institutions, in accordance with the law, explanations, data and documents. <\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-05e430b elementor-widget elementor-widget-text-editor\" data-id=\"05e430b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><p><span lang=\"SQ\">The institutions of public administration, according to the competence and legal procedures that regulate the activity of the office, are obliged to fulfill the demands of the lawyer.<\/span><\/p><\/li><li><p><span lang=\"SQ\">In case of non-fulfillment of the obligation of public administration institutions or other non-public entities, the lawyer has the right to submit within 5 days to the court the request for the fulfillment of the obligation through a judicial decision.<\/span><\/p><\/li><li><p><span lang=\"SQ\">The prosecution body, the court, the prison administration and the State Police are obliged to ensure the presence of the lawyer, when the person protected by him, detained, arrested or who is serving the sentence, requests it. In all cases, the presence of the lawyer must be ensured immediately.<\/span><\/p><\/li><li><p><span lang=\"SQ\">The lawyer does not have the right to request and offer legal assistance to a detained or arrested person, without the latter&#039;s request.<\/span><span lang=\"SQ\">\u00a0<\/span><\/p><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bd0f1cf elementor-widget elementor-widget-spacer\" data-id=\"bd0f1cf\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a3ddaa4 elementor-widget elementor-widget-heading\" data-id=\"a3ddaa4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">The lawyer has the duty to exercise his profession with honesty and dignity, to respect the rules of professional ethics and to use all the legal means for the faithful protection of the rights and interests of the persons who are protected or represented by him. <\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2fcec1e elementor-widget elementor-widget-text-editor\" data-id=\"2fcec1e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><p><span lang=\"SQ\">The lawyer must ensure that no conflict of interest exists between him and the person he defends or represents.<\/span><\/p><\/li><li><p><span lang=\"SQ\">The lawyer is forbidden to make public the data that he has learned through the person protected or represented by him or from the documents that the latter has made available to him, in function of the requested protection, with the exception of the case when he has given his written approval.<\/span><\/p><\/li><li><p><span lang=\"SQ\">The lawyer is forbidden to make a report to the criminal prosecution body and cannot be questioned as a witness about the person to whom he has provided legal services and assistance, as well as about the circumstances that he has learned during the exercise of the lawyer&#039;s profession.<\/span><\/p><\/li><li><p><span lang=\"SQ\">A lawyer is forbidden to take part in a case, when he has previously been assigned to it as a judge, prosecutor, Judicial Police officer or as a witness.<\/span><\/p><\/li><li><p><span lang=\"SQ\">The lawyer is not allowed to provide legal assistance or represent a person, when he has previously advised or represented the opposing party in the same case, or when the lawyer is related by blood or has the same interest as the opposing party.<\/span><\/p><\/li><li><p><span lang=\"SQ\">Female lawyers, who serve in the same law office, are not allowed to represent opposing parties in the same case.<\/span><\/p><\/li><li><p><span lang=\"SQ\">Lawyers, who practice their profession near the same law office, are presumed to be aware of and possess the documents for anyone who has been protected or represented by their office.<\/span><\/p><\/li><li><p><span lang=\"SQ\">Except for the cases provided above in this article, the lawyer is obliged to make sure that he does not act in conflict with the interests of the person who is protected or represented by him. When the lawyer suspects that he is acting in a conflict of interest, he must obtain written approval from the parties who are thought to be affected by this conflict of interest.<\/span><span lang=\"SQ\">\u00a0<\/span><\/p><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c7f5649 elementor-widget elementor-widget-spacer\" data-id=\"c7f5649\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-68d2fd1 elementor-widget elementor-widget-heading\" data-id=\"68d2fd1\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">The lawyer provides services to the client against a fee. The reward for the work performed is determined in the following ways: \n<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0303da5 elementor-widget elementor-widget-text-editor\" data-id=\"0303da5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><p><span lang=\"SQ\">By agreement between him and the party protected or represented by him;<\/span><\/p><\/li><li><p><span lang=\"SQ\">By the court or the prosecution, when it is mainly appointed or when the protected or represented person does not have financial means and the legal aid for him is free.<\/span><\/p><\/li><li><p><span lang=\"SQ\">The amount of remuneration for these cases is determined by a joint decision of the Minister of Justice and the governing council of the National Bar Association;<\/span><\/p><\/li><li><p><span lang=\"SQ\">By law.<\/span><\/p><\/li><li><p><span lang=\"SQ\">In all cases, the lawyer is not allowed to receive any other remuneration.<\/span><\/p><\/li><li><p><span lang=\"SQ\">The lawyer cannot ask the person he defends or represents to be rewarded by him with a percentage during the trial process. The percentage reward, pre-calculated or not, can be paid only when it is provided for in the agreement between the lawyer and the person he defends or represents, for the case of successful defense or representation of the case.<\/span><\/p><\/li><li><p><span lang=\"SQ\">The lawyer is allowed to be paid with a commission in cases where he ensures the return of the loan for the person who is defended or represented by him extrajudicially.<\/span><\/p><\/li><li><p><span lang=\"SQ\">If the lawyer decides to give up the representation or further protection of a person, he is obliged to notify him 15 days before the end of his service. In such a case, the lawyer, together with all the documents related to the case, is obliged to return to the client the advance payment he received from him, unless, together, they agree otherwise.<\/span><\/p><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>\u00a0 \u00a0 Reforma p\u00ebr ushtrimin e profesionit te avokatit ne Shqip\u00ebri po ec\u00ebn me hapa t\u00eb shpejt\u00eb dhe konkret\u00eb. Partneriteti i ri me avokatet aktive mund\u00ebson m\u00eb shum\u00eb bashk\u00ebveprim k\u00ebrkon njohje dhe zbatim me ndershm\u00ebri t\u00eb t\u00eb drejtave dhe detyrimeve nga t\u00eb dyja pal\u00ebt. \u00c7do Avokat ka t\u00eb drejt\u00eb q\u00eb t\u00eb marr\u00eb falas informacion p\u00ebr legjislacionin aktual dhe ndihm\u00eb p\u00ebr zbatimin e tij, nga administrata e DH.K.A. Administrata e DH.K.A. ka p\u00ebr detyr\u00eb q\u00eb t\u00eb informoj\u00eb an\u00ebtaret e saj p\u00ebr p\u00ebrmbajtjen, rolin dhe r\u00ebnd\u00ebsin\u00eb e legjislacionit te fush\u00ebs. Departamenti i Sh\u00ebrbimit dhe Regjistrimit t\u00eb asistenteve p\u00ebr avokat pran\u00eb DH.K.A. n\u00eb Shqip\u00ebri, ka rolin e informimit dhe t\u00eb ndihm\u00ebs p\u00ebr te gjith\u00eb aplikonte n\u00ebp\u00ebrmjet materialeve informative, duke p\u00ebrdorur t\u00eb gjitha mjetet e komunikimit masiv dhe individual. Komunikimi zyrtar me an\u00ebtaret e dhomave d\u00ebrgohet n\u00eb adres\u00ebn e deklaruar prej tij dhe num\u00ebrin personal te telefonit t\u00eb sh\u00ebnuar n\u00eb regjistrin e avokatit. Avokati mund ta ushtroje profesionin e tij ne te gjith\u00eb territorin e Republik\u00ebs se Shqip\u00ebris\u00eb dhe p\u00ebrpara \u00e7do gjykate, prokurorie ose organi te administrat\u00ebs publike. \u00a0Avokati ushtron profesionin e tij individualisht ose ne bashk\u00ebpunim me avokate te tjer\u00eb, duke u organizuar ne zyra avokatie. Avokati mund ta ushtroje profesionin e tij edhe jasht\u00eb territorit te Republik\u00ebs se Shqip\u00ebris\u00eb, ne p\u00ebrputhje me ligjin e shtetit ku jepet ndihma juridike. Avokati, gjate ushtrimit te profesionit te tij, nuk mund te jete, nj\u00ebkoh\u00ebsisht, gjyqtar, prokuror, noter, n\u00ebpun\u00ebs civil ose punonj\u00ebs i administrates. Ne \u00e7do rast, avokati ne ushtrimin e profesionit, identifikohet me num\u00ebrin e lejes se ushtrimit te profesionit, si dhe kodin fiskal te tij apo te zyr\u00ebs se avokatis\u00eb ku b\u00ebn pjese. Avokati, ne funksion te ushtrimit te profesionit te tij, ka te drejte te k\u00ebrkoje nga institucionet e administrat\u00ebs publike, ne p\u00ebrputhje me ligjin, shpjegime, te dh\u00ebna dhe dokumente. Institucionet e administrat\u00ebs publike, sipas kompetenc\u00ebs dhe procedurave ligjore qe rregullojn\u00eb veprimtarin\u00eb e zyre, jan\u00eb te detyruara te p\u00ebrmbushin k\u00ebrkesat e avokatit. Ne rast te mos p\u00ebrmbushjes se detyrimit te institucioneve te administrat\u00ebs publike ose nga entet e tjera jopublike, avokati ka te drejte te paraqes\u00eb brenda 5 dit\u00ebve ne gjykate k\u00ebrkes\u00ebn p\u00ebr realizimin e detyrimit n\u00ebp\u00ebrmjet nj\u00eb vendimi gjyq\u00ebsor. Organi i prokuroris\u00eb, gjykata, administrata e burgjeve dhe Policia e Shtetit jan\u00eb te detyruara te sigurojn\u00eb pranin\u00eb e avokatit, kur k\u00ebt\u00eb e k\u00ebrkon personi i mbrojtur prej tij, i ndaluar, i arrestuar ose qe \u00ebsht\u00eb duke vuajtur d\u00ebnimin. Ne te gjitha rastet, prania e avokatit duhet te sigurohet menj\u00ebher\u00eb. Avokati nuk ka te drejte t\u2019i k\u00ebrkoj\u00eb dhe t\u2019i ofroje ndihme juridike nj\u00eb personi te ndaluar ose te arrestuar, pa k\u00ebrkes\u00ebn e k\u00ebtij te fundit.\u00a0 Avokati ka p\u00ebr detyre te ushtroje profesionin e vet me ndershm\u00ebri dhe dinjitet, t\u00eb respektoje rregullat e etikes profesionale dhe te p\u00ebrdore te gjith\u00eb mjetet e ligjshme p\u00ebr mbrojtjen me besnik\u00ebri t\u00eb t\u00eb drejtave dhe interesave te personave qe mbrohen ose p\u00ebrfaq\u00ebsohen prej tij. Avokati duhet te siguroje qe asnj\u00eb konflikt interesash nuk ekziston nd\u00ebrmjet tij dhe personit qe mbron ose p\u00ebrfaq\u00ebson. Avokatit i ndalohet te beje publike te dh\u00ebnat, qe i ka m\u00ebsuar n\u00ebp\u00ebrmjet personit te mbrojtur ose te p\u00ebrfaq\u00ebsuar prej tij ose nga dokumentet qe ky i fundit i ka vene ne dispozicion, ne funksion te mbrojtjes se k\u00ebrkuar, me p\u00ebrjashtim te rastit kur ai ka dh\u00ebn\u00eb miratimin e tij me shkrim. Avokatit i ndalohet te beje kall\u00ebzim ne organin e ndjekjes penale dhe nuk mund te pyetet si d\u00ebshmitar p\u00ebr personin, te cilit i ka kryer sh\u00ebrbime dhe ndihme juridike, si dhe p\u00ebr rrethanat qe ai i ka m\u00ebsuar gjate ushtrimit te profesionit te avokatit. Avokatit i ndalohet te marre pjese ne nj\u00eb \u00e7\u00ebshtje, kur ai ka qene i ngarkuar me pare ne te si gjykat\u00ebs, prokuror, oficer i Policis\u00eb Gjyq\u00ebsore ose si d\u00ebshmitar. Avokati nuk lejohet te jap\u00eb ndihme ligjore ose te p\u00ebrfaq\u00ebsoje nj\u00eb person, kur ka k\u00ebshilluar ose ka p\u00ebrfaq\u00ebsuar me pare pal\u00ebn kund\u00ebrshtare ne te nj\u00ebjt\u00ebn \u00e7\u00ebshtje, ose kur avokati ka lidhje gjaku apo ka interes te nj\u00ebjt\u00eb me pal\u00ebn kund\u00ebrshtare. Avokatet, qe sh\u00ebrbejn\u00eb ne te nj\u00ebjt\u00ebn zyre avokatie, nuk lejohen te p\u00ebrfaq\u00ebsojn\u00eb pal\u00ebt kund\u00ebrshtare ne te nj\u00ebjt\u00ebn \u00e7\u00ebshtje. Avokatet, qe ushtrojn\u00eb profesionin e tyre pran\u00eb se nj\u00ebjt\u00ebs zyre avokatie, prezumohet se jan\u00eb ne dijeni dhe zot\u00ebrojn\u00eb dokumentet p\u00ebr k\u00ebdo qe \u00ebsht\u00eb mbrojtur apo p\u00ebrfaq\u00ebsuar nga zyra e tyre. P\u00ebrve\u00e7 rasteve te parashikuara me sip\u00ebr ne k\u00ebt\u00eb nen, avokati \u00ebsht\u00eb i detyruar te sigurohet se nuk vepron ne konflikt me interesat e personit qe mbrohet ose p\u00ebrfaq\u00ebsohet prej tij. Kur avokati dyshon se \u00ebsht\u00eb duke vepruar ne konflikt interesash, ai duhet te marre miratimin me shkrim nga pal\u00ebt te cilat mendohet se preken nga ky konflikt interesash.\u00a0 Avokati kryen sh\u00ebrbimin ndaj klientit kundrejt nj\u00eb shp\u00ebrblimi. Shp\u00ebrblimi p\u00ebr pun\u00ebn e kryer caktohet me k\u00ebto m\u00ebnyra: Me marr\u00ebveshje nd\u00ebrmjet tij dhe pal\u00ebs se mbrojtur ose te p\u00ebrfaq\u00ebsuar prej tij; Nga gjykata ose prokuroria, kur ai \u00ebsht\u00eb caktuar kryesisht ose kur personi i mbrojtur ose i p\u00ebrfaq\u00ebsuar nuk ka mund\u00ebsi financiare dhe ndihma ligjore p\u00ebr te \u00ebsht\u00eb falas. Masa e shp\u00ebrblimit p\u00ebr k\u00ebto raste p\u00ebrcaktohet me vendim te p\u00ebrbashk\u00ebt te ministrit te drejt\u00ebsis\u00eb dhe k\u00ebshillit drejtues \u00a0\u00a0\u00a0\u00a0te dhom\u00ebs komb\u00ebtare te avokatis\u00eb; Me ligj. Ne te gjitha rastet, avokatit nuk i lejohet te marre shp\u00ebrblim tjet\u00ebr. Avokati nuk mund te k\u00ebrkoj\u00eb nga personi qe mbron ose p\u00ebrfaq\u00ebson, qe te shp\u00ebrblehet prej tij me p\u00ebrqindje gjat\u00eb procesit te gjykimit .shp\u00ebrblimi me p\u00ebrqindje, i parallogaritur ose jo, mund te paguhet vet\u00ebm kur \u00ebsht\u00eb parashikuar ne marr\u00ebveshjen nd\u00ebrmjet avokatit dhe personit qe ai mbron ose p\u00ebrfaq\u00ebson, p\u00ebr rastin e mbrojtjes apo p\u00ebrfaq\u00ebsimit te suksessh\u00ebm te \u00e7\u00ebshtjes.
