The high level of quality and ethics of the lawyer&#039;s profession are the main conditions to preserve the lawyer&#039;s independence from all powers, to strengthen the function in the public interest, to minimize the interventions imposed by the prevailing rules of the market and competition.<\/p><p>The administration of the profession of lawyer in defense of the interests of the community, guaranteeing the competence and professionalization of lawyers is entrusted to the governing bodies of the National Chamber of Lawyers, in support of Article 21 (point c) of Law No. No. 9109, dated 17.7.2003 &quot;On the Profession of Lawyer in the Republic of Albania&quot;, amended by law no. 9795, dated 23.7.2007 and law no. 10 047, dated 24.12.2008, &quot;General Council... examines and analyzes the work progress and professional training of lawyers and assistants, who are part of the lawyer&#039;s room&quot;.<\/p><p>The drafting and determination of policies aimed at the professional development of lawyers has been entrusted to the National Chamber of Advocates of Albania, provided for in Article 2 of the Statute of the National Chamber of Advocacy &quot;Drafting and implementation of policies aimed at professional development, the creation of an environment and infrastructure which increases the well-being, trust and pride of lawyers for their organization&quot;.<\/p><p>The Lawyer&#039;s Code of Ethics, in Article 8, imposes an obligation related to professional competence, defining that &quot;A lawyer should not deal with a matter for which he does not have the necessary skills, except when he cooperates with a lawyer who is competent for them treat it&quot;. In addition, Article 9 of the Lawyer&#039;s Code of Ethics provides that &quot;The lawyer has the duty to develop his skills through continuous professional training&quot; through, among others, &quot;...Meetings, seminars, professional debates, generalizations of the experience of lawyers, law offices and chambers of lawyers, increasing the publishing ability with legal topics of lawyers in periodical press bodies, etc.<\/p><ul><li style=\"list-style-type: none;\"><ul>Beyond the field of professional behavior and deontological obligation, equipping with appropriate knowledge and skills, including those of a specific character, updating and adding them periodically, is a constant requirement for lawyers in Europe and the basic acts that regulate the Legal Profession in the context of the European Community, mentioning among others:<\/ul><\/li><\/ul><p>\u00a0<\/p><ul><li>Directives of the European Union in the exercise of the legal profession in cross-border matters.<\/li><li>The jurisprudence of the European Court of Justice and the European Court of Human Rights.<\/li><li>Recommendation Rec (2000) 21 of October 25, 2000 of the Committee of Ministers of the Council of Europe for member states regarding the freedom to exercise the profession of lawyer.<\/li><li>Resolution of the European Parliament on legal professions and the general interest in the functioning of legal systems of March 23, 2006.<\/li><li>Charter of Fundamental Principles of the Legal Profession in Europe, 2006.<\/li><li>The Rome Declaration on the Training of Lawyers in Europe, November 2008.<\/li><li>Recommendations of the Council of Bars and Legal Associations in Europe (CCBE); etc.<\/li><\/ul><p>In order to achieve the aforementioned objectives, on May 12, 2011, the Memorandum of Understanding was signed by the Director of USAID for Albania, Mr. Joseph Williams, and the Chairman of DHKASH, Mr. Maksim Haxhia, for the AVL Program, which has started to be tested, in the form of a demonstration project in the Regional Chamber of Vlora and Durr\u00ebs for lawyers and assistant lawyers of these chambers. Nr.9109, dat\u00eb 17.7.2003 \u201d Per Profesionin e Avokatit ne Republiken e Shqiperise\u201d, ndryshuar me ligjin nr.9795, dat\u00eb 23.7.2007 dhe ligjin nr. 10 047, dat\u00eb 24.12.2008, \u201cKeshilli i Pergjithshem\u2026. shqyrton dhe analizon ecurin\u00eb n\u00eb pun\u00eb dhe trajnimin profesional t\u00eb avokat\u00ebve dhe t\u00eb asistent\u00ebve, q\u00eb b\u00ebjn\u00eb pjes\u00eb n\u00eb dhom\u00ebn e avokatis\u00eb\u201d. Hartimi dhe percaktimi i politikave qe synojne ngritjen profesionale te avokateve i eshte besuar Dhomes Kombetare te Avokateve te Shqiperise, e parashikuar ne Nenin 2 te Statutit te Dhomes Kombetare te Avokatise \u201cHartimi dhe zbatimi i politikave qe synojne ngritjen profesionale, krijimin e nje ambjenti dhe infrastrukture qe rrit mireqenien, besimin dhe krenarine e avokateve per organizaten e tyre\u201d. Kodi Etik i Avokatit, ne Nenin 8, vendos nje detyrim lidhur me kompetencen profesionale, duke percaktuar se \u201cAvokati nuk duhet t\u00eb trajtoj\u00eb nj\u00eb c\u00ebshtje p\u00ebr t\u00eb cil\u00ebn ai nuk ka aft\u00ebsit\u00eb e nevojshme pervec se kur bashk\u00ebpunon me nj\u00eb avokat i cili \u00ebsht\u00eb kompetent p\u00ebr ta trajtuar at\u00eb\u201d. GjitahsNeni 9 i Kodit Etik te Avokatit parashikon se \u201cAvokati ka p\u00ebr detyr\u00eb t\u00eb zhvilloj\u00eb aft\u00ebsit\u00eb e tij n\u00ebp\u00ebrmjet p\u00ebrgatitjes s\u00eb vazhduar profesionale\u201d nepermjet nder te tjera, \u201c\u2026\u2026Takimeve, seminareve, debateve profesionale, pergjithesimeve te pervojes se avokateve, zyrave avokatore dhe dhomave te avokateve, rritjes se aftesise botuese me tematike juridike te avoktave ne organet e shtypit periodik, etj\u201d. Pertej fushes se sjelljes profesionale dhe detyrimit deontologjik, pajisja me njohurite dhe aftesite e duhura, perfshire dhe ato te nje karakteri specifik, perditesimi dhe shtimi i tyre ne menyre periodike, eshte nje kerkese e vazhdueshme per avokatet ne Europe dhe akteve themelore qe rregullojne Profesionin Ligjor ne kontekstin e Komunitetit Europian duke permendur nder te tjera: \u00a0 Direktivat e Bashkimit Europian ne ushtrimin e profesionit ligjor ne ceshtjet nderkufitare. Jurisprudencen e Gjykates Europiane te Drejtesise dhe Gjykates Europiane te te Drejtave te Njeriut. Rekomandimin Rec (2000) 21 te dates 25 Tetor 2000 te Komitetit te Ministrave te Keshillit te Europes per shtetet anetare lidhur me lirine e ushtrimit te profesionit te avokatit. Rezoluten e Parlamentit Europian mbi profesionet ligjore dhe interesin e pergjithshem ne funksionimin e sistemeve ligjore te 23 Mars 2006. Karten e Parimeve Themelore te Profesionit Ligjor ne Europe, 2006. Deklaraten e Romes per Trajnimin e Avokateve ne Europe, Nentor 2008. Rekomandimet e Keshillit te Bareve dhe Shoqatave Ligjore ne Europe (CCBE); etj. Per te realizuar objektivat e siperpermendur, me date 12 Maj 2011 u nenshkrua Marreveshja e Mirekuptimit e firmosur nga Drejtori i USAID per Shqiperine, Z. Joseph Williams dhe Kryetari i DHKASH-s\u00eb, Z. Maksim Haxhia, per Programin e AVL i cili ka filluar te testohet, n\u00eb form\u00ebn e nj\u00eb projekti demonstrues ne Dhom\u00ebn Rajonale t\u00eb Vlor\u00ebs dhe Durr\u00ebsit per avokatet dhe asistent avokatet e ketyre dhomave.
